1. Introduction

These Terms and Conditions govern the use of the Menbru platform, which was founded in 2023 by Alejandro Mendoza and Bruno Balanzar to provide tourist information and access to discount coupons in Jackson Hole, Wyoming. Menbru's services are designed to connect tourists with local businesses, providing them with deals and recommendations to enrich their travel experience.

2. Eligibility and Account Registration

• Minimum Age: Users must be at least 18 years old to create an account on Menbru. Minors may use the services only with the supervision and explicit consent of a legal guardian.
• Registration Process: Registration requires providing truthful and complete information, including a valid email address. A secure password must be chosen and kept confidential. Menbru will not be liable for any unauthorized access resulting from a user's failure to protect his or her credentials.
• Identity Verification: Menbru may, at any time, request additional documents or information to verify the user's identity or the validity of the data provided. Failure to cooperate may result in account suspension or cancellation.

3. Subscription Plans and Fees

• Subscription Plan Details: Subscription to Menbru provides full access to exclusive coupons, discounts at local businesses, and premium content about activities and services in Jackson Hole. Current prices are posted in the fees section of the website.
• Automatic Renewal: Subscription automatically renews at the end of each monthly billing period. Users will receive a reminder prior to renewal so they can cancel or adjust their subscription if they wish.
• Cancellation and Refund Policy: Users may cancel their subscription at any time through their account settings. Cancellation will be effective at the end of the billing cycle and no refunds will be given for the remaining time. Under special circumstances, such as billing errors, Menbru may issue partial refunds at its discretion.

4. Use of the Services and Restrictions

Personal and Non-Commercial Use: The services are intended solely for the personal use of the user. It is prohibited to resell, share or distribute the discount coupons obtained through Menbru.

5. Promotions, Offers and Coupons

• Offer Terms and Conditions: Each offer, promotion or coupon may be subject to specific terms, such as expiration dates, usage restrictions or limitations per user. The terms will be clearly stated in the offer description.
• Offer Changes and Availability: Local businesses may modify or withdraw offers at any time. Menbru is not responsible for the availability of promotions or their acceptance by participating businesses.
• Fraud or Inappropriate Use of Coupons: If fraud or improper use of coupons is detected, Menbru reserves the right to cancel the user's account and report the incident to the appropriate authorities.

6. Content Ownership and Copyright

• Intellectual Property Rights: All content, including text, images, graphics, logos, and coupons, is the exclusive property of Menbru or its business partners. Reproduction, distribution, modification, or use of the content without Menbru's express written consent is strictly prohibited.
• User Generated Content: Any content submitted by users, such as reviews or comments, grants Menbru a non-exclusive, worldwide, perpetual license to use, modify, and distribute such content in connection with the site.

7. Limitation of Liability

• Disclaimer of Warranties: Menbru's services are provided on an “as is“ and “as available“ basis. We do not guarantee that the website will always be error-free or uninterrupted, or that coupons will be honored by all local businesses.
• Limitation of Damages: To the extent permitted by law, Menbru shall not be liable for any direct, indirect, incidental or consequential damages resulting from the use of the services. The maximum liability to any one user is limited to $100.

8. Service Modifications and Termination

• Changes to the Services: Menbru may modify, suspend or discontinue any aspect of its services at any time. When possible, we will notify users in advance.
• Termination of Accounts: Menbru reserves the right to terminate any account that breaches these Terms. In the event of termination, users will not receive refunds for the remaining time on their subscriptions.

9. Governing Law and Dispute Resolution

• Jurisdiction: These Terms are governed by the laws of the state of Wyoming. Disputes will be resolved through arbitration, in accordance with the rules of the American Arbitration Association (AAA).
• Class Action Waiver: All users agree to resolve their disputes individually and waive their right to file class actions.
